Bill 88 Passed — What Does This Mean for Maui Condos?

If you’ve been following Maui real estate lately, you’ve probably heard a lot of conversation around vacation rentals, zoning changes, and Bill 88.

So… what exactly happened?

The Maui County Council recently passed Bill 88, which creates two new hotel zoning categories (H-3 and H-4) designed to provide a potential pathway for certain long-standing vacation rental properties currently located in apartment-zoned districts.

The important thing to understand:

Bill 88 does not automatically change the zoning of any property.

Instead, it creates a framework where eligible properties may be able to apply for rezoning in the future.

For many Maui condo owners, buyers, and investors, this is another step in an ongoing conversation about balancing visitor accommodations, property rights, housing needs, and Maui’s future.

So what does this mean if you own or are thinking about buying a condo?
